He said his Colorado birth certificate and Social Security card were at his home in Austin and could prove it.

Authorities did not accept his account.

The Department of Homeland Security said record checks identified him as someone unlawfully present in the United States. DHS also said Morales García admitted that he was a Mexican citizen who had entered the country illegally.

Morales García tells a markedly different story. He says officers accused him of lying, threatened him with prison and eventually induced him to provide the answers they wanted. Fearing months in detention and desperate to return to his wife and newborn daughter in Mexico, he signed documents authorizing his removal.

Nearly five months later, after his attorneys supplied a certified Colorado birth record, hospital records and witness affidavits, the Department of Justice permitted him to reenter the United States while his federal civil-rights case proceeds.

The government has not publicly conceded that it wrongfully deported a citizen. But Morales García is once again living in Austin, working to rebuild the life that disappeared after a traffic stop.

A family with roots on both sides of the border

Morales García’s story began in Denver.

His mother, María del Socorro García, moved there from Mexico with her sister in 1999, according to an account she provided to The Texas Tribune. She cleaned offices and lived in an apartment complex, where she met a restaurant cook who would become Brian’s father.

Brian was born in Denver in 2001. His brother, Miguel Morales García, was born the following year.

Their mother returned to Mexico with the children in 2002 so they could meet their grandfather, who was struggling with diabetes. Her husband followed, and the family decided to remain in Mexico and raise the boys there.

Brian grew up in Aguascalientes and speaks little or no English. He also holds Mexican citizenship.

That cross-border history would later become central to the government’s doubts about his identity.

When the family registered Brian as a Mexican citizen, his mother said, a clerk spelled his first name “Bryan”—a common Spanish variation—and entered a different date of birth without comparing the information with his American birth certificate. Immigration attorney and Ohio State University law professor César Cuauhtémoc García-Hernández told the Tribune that variations between the documents of dual citizens are not unusual.

The family nevertheless possessed evidence of Brian’s Denver birth. The Tribune reviewed his birth certificate, Social Security card and a hospital record showing that he was admitted to a Denver hospital on the day he was born.

Brian’s brother, Miguel, eventually returned to the United States because he wanted to reconnect with what he called his “roots.” After settling in Denver, Miguel obtained copies of both brothers’ birth certificates and later delivered Brian’s copy to him in Mexico.

In January 2025, Brian traveled from Aguascalientes to Ciudad Juárez and crossed at the El Paso port of entry. He says he presented his American birth certificate to Customs and Border Protection officers and was allowed into the country.

His reason for returning was practical and deeply personal: His wife was pregnant, and he wanted to earn money to support their growing family.

Brian initially stayed with Miguel in Denver. After struggling to find work, he moved to Austin and obtained a job installing air-conditioning systems.

A passenger in a stopped truck

On April 3, 2026, Brian was riding with his boss and another worker to a job near Fredericksburg when a Texas Department of Public Safety trooper stopped their pickup because of an alleged window-tint violation.

Brian was a passenger, not the driver.

According to DPS, the trooper called deputies from the Gillespie County Sheriff’s Office and officers from the Fredericksburg Police Department to help translate for Brian and another passenger. Officers then contacted federal immigration authorities, who asked that the men be held.

In this 2025 file photo, an Immigration and Customs Enforcement agent points to his badge during a traffic stop in Springfield, Oregon. Chris Pietsch, The Register-Guard via USA TODAY Network, File

Brian said he could not immediately produce identification. He nevertheless repeatedly asserted that he was an American citizen and told officers where his birth certificate and Social Security card could be found.

He was booked into the Gillespie County Jail and later transferred to federal custody. Over five days, he said, authorities moved him through five facilities.

His family initially believed his citizenship would quickly settle the matter.

“At first I thought, ‘Well he’s a U.S. citizen,’” Miguel told the Tribune.

Instead, Miguel said the family struggled even to determine where Brian had been taken. He learned that his brother was in an immigration detention center only after a Univision reporter contacted him.

Brian says federal agents rejected his explanation that he had entered legally through El Paso. According to his account, officers warned that he could face prison if he continued claiming citizenship or maintained that he had presented a birth certificate at the border.

DHS said agents reached a different conclusion.

“Agents determined Morales-Garcia was illegally in the U.S. through record checks,” the department said in a statement reported by the Tribune. DHS said he admitted being a Mexican national who entered unlawfully and was therefore removed on April 7.

Brian says that admission was not true. He maintains that he eventually invented details about an illegal border crossing because officers would not accept his answers and he feared prolonged confinement.

There was another reason he wanted out: His wife and newborn daughter were waiting in Mexico.

He signed the removal documents and was placed on a flight out of the United States.

His family searches for answers

For Brian’s mother, the government’s treatment of her son was incomprehensible.

“I feel angry because he’s from there,” Socorro García said.

The documents supporting Brian’s claim did not vanish simply because he had been deported. His family and attorneys began assembling them into a legal case.

Attorneys Kate Lincoln-Goldfinch, Dicky Grigg and Chad Dunn filed a lawsuit in the Western District of Texas seeking Brian’s return and protection against another removal. The case names federal immigration officials, unidentified immigration officers and unidentified state and local officers as defendants.

The lawsuit’s allegations have not been adjudicated, and a judge has not issued a final finding that the officers violated Brian’s rights.

As the case proceeded, his lawyers supplied additional evidence: hospital documents, sworn witness statements and a certified Colorado birth record. That was in addition to the birth certificate and Social Security card previously presented to reporters.

The Department of Justice subsequently reached an agreement with his attorneys allowing Brian to return while the litigation continues. He crossed into Texas at Laredo on August 30, where Lincoln-Goldfinch met him.

DHS and DOJ did not provide comments to the Tribune immediately following his return. DHS has not publicly withdrawn its earlier statement disputing his version of events.

That leaves an extraordinary contradiction at the center of the case: The government removed Brian after determining he was unlawfully present, then allowed him back after his attorneys produced further evidence of the citizenship he had asserted from the beginning.

Back home—but not back to normal

Brian returned to Austin eager to resume working and supporting relatives in both countries. But his return has not erased what happened.

He has questioned whether another encounter with police could produce the same outcome.

His brother shares that fear. Miguel, who works as a cashier at a McDonald’s and is still learning English, told the Tribune that Brian’s experience made him worry that he could also be stopped, questioned and disbelieved.

Courtesy USA Today

The case presents a broader constitutional concern: American citizens are not generally required to carry birth certificates or proof of citizenship while traveling inside the United States. Yet Brian’s inability to produce those records beside a Texas highway appears to have helped turn a window-tint stop into an immigration detention.

It also raises questions about Texas’ expanding cooperation with federal immigration authorities.

Hundreds of Texas law-enforcement agencies have entered agreements to assist ICE, and state law requires most county sheriffs to participate in federal immigration enforcement. The Trump administration has also streamlined training as it expands the number of local officers performing immigration-related duties.

Immigration law is complicated even for experienced federal officials. Giving local officers a larger role increases the possibility that language, ethnicity, inconsistent records or unfamiliarity with dual citizenship will be mistaken for evidence that someone is unlawfully present.

Morales García’s attorney has characterized his detention as the result of racial profiling and overzealous enforcement. State officials have not publicly accepted that characterization.

But the outcome is no longer hypothetical. A Spanish-speaking Latino passenger was unable to produce identification during a traffic stop. He claimed American citizenship and offered a way to verify it. Within days, the government had removed him.

Not the first warning

Wrongful detention or removal of citizens is considered rare, but government records show that it is not unprecedented.

A 2021 Government Accountability Office review found that immigration authorities arrested 674, detained 121 and removed 70 “potential U.S. citizens” between fiscal years 2015 and 2020. The word “potential” is important: The report did not conclude that every person in those figures was ultimately proven to be a citizen.

More recently, a ProPublica investigation identified more than 170 American citizens detained by immigration authorities during the first nine months of President Donald Trump’s second administration. That investigation did not identify a citizen who had been deported during the period it examined.

Brian’s case shows what can happen when an enforcement system designed for speed encounters a citizen whose life does not fit neatly into a database.

He was born in Colorado but raised in Mexico. He is an American and Mexican citizen. His U.S. and Mexican records contain different versions of his name and birth date. He speaks Spanish rather than English.

None of those circumstances cancels citizenship.

It took five days for the government to send Brian José Morales García out of the country. It took his family, his lawyers, a federal lawsuit and nearly five months to bring him home.

Whether anyone will be held accountable remains an unanswered question.

Sources and editorial note

This article is based on reporting and documentary descriptions published by The Texas Tribune on April 23, August 30 and September 2, as well as the public federal-court docket and the Government Accountability Office’s 2021 review.

The Tribune reported that its journalists reviewed Morales García’s birth certificate, Social Security card, Denver hospital record and Mexican identification. State of Disorder did not independently inspect those documents or interview Morales García or his relatives. Family quotations in this article originate from the Tribune’s interviews.

DHS previously disputed Morales García’s citizenship claim and said record checks showed that he was unlawfully present. His attorneys contend that he is a native-born citizen and that any admission of illegal entry was coerced. The Department of Justice permitted him to return after receiving additional evidence, but the federal government has not publicly conceded wrongdoing.
